1. INTRODUCTION
Welcome to kokoda.mk. These terms of use govern your access to and use of our website and the services we offer. By using our website, you agree to these terms. If you do not agree to these terms, please do not use our website. kokoda.mk is an e-commerce platform that offers a variety of products, starting with clothing, but in future we will include other products. These terms and conditions apply to all users of the website including, but not limited to, visitors, users, sellers and customers.
The legal entity DPTU Kokoda Online DOOEL Skopje, and the trade brand kokoda.mk, hereinafter referred to as the name kokoda.mk. The subject of these General Terms and Conditions is to determine the terms and conditions for online ordering, payment and purchase of products through the kokoda.mk website https//www.kokoda.mk. Each of the expressions listed below has the following meaning within the meaning of these General Terms and Conditions for Online Purchase: A visitor to the site is any person who, through electronic means of communication, accesses the website https://kokoda.mk and reviews the offer of products and/or services on kokoda.mk. A buyer is a natural or legal person who, through the kokoda.mk website, orders and purchases products and/or services from the offer of kokoda.mk. The Visitor or Buyer, who enters into a business relationship with kokoda.mk, shall be subject to the positive legal regulations in the Republic of North Macedonia in the field of electronic communications, electronic commerce, personal data protection and consumer protection, as well as the General Terms and Conditions for the manner of access and use of public communication services on kokoda.mk.
2. BUYER REGISTRATION

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password.
The buyer who wants to become a user of the e-commerce service and wants to order and purchase a product or service from kokoda.mk through the website https://kokoda.mk/ is required, after selecting the product(s) and placing them in the shopping cart, to register at https://kokoda.mk/, in order to be able to initiate and complete the online order in e-commerce. The registered online buyer, by filling out the forms when purchasing on the website https://kokoda.mk/, fully confirms the accuracy of the data entered in the form, including personal data. At the time of ordering a specific product/s from the offer, the Buyer agrees to these General Terms and Conditions for online ordering, payment and purchase of product/s through the Kokoda.mk website. Kokoda.mk reserves the right to modify these Rules or dismiss the Online Trade Program. In these cases, the same will be published on the kokoda.mk website, https://kokoda.mk/.
3. TERMS AND CONDITIONS FOR PURCHASE
The prices of all products on https://kokoda.mk/ are expressed in denars including VAT. Prices for online purchases may be preferential and lower than retail prices in Kokoda.mk stores and will be appropriately indicated on the https://kokoda.mk/ web application. Our website offers various products and services. All descriptions, prices and availability of products are subject to change without prior notice. We strive to provide accurate product information, but we do not guarantee that product descriptions or other content on the website are accurate, complete, reliable, current or error-free. Kokoda.mk reserves the right to change prices, in accordance with the company’s policy, without notice to users. No price correction will be made if the order is accepted. The buyer undertakes to pay the price offered at the time of placing the order, regardless of the fact that the price may be changed in the meantime. Items marked with special promotional prices, for which special promotional conditions apply and which are limited in quantity, for objective reasons may not be processed in the system, in orders with such items may be cancelled. The buyer can select one or more products, as well as a package of products from the offer of Kokoda.mk. The buyer can cancel, supplement or correct the order at any time, before making the payment. Registration is mandatory for the realization of the order, and when ordering, contact information, as well as a delivery address, are mandatory. After completing the order, an e-mail will be sent to the address you have provided, to confirm the order. In case of possible technical problems with the website, Kokoda.mk has the right to refuse the order or to terminate the purchase process, and we are not obliged to provide any compensation, except for the refund of the funds paid by the buyer.
4. PAYMENT METHODS
Payment for Kokoda.mk products and services purchased through the website https://kokoda.mk/ (hereinafter: Products) can be made in one of the following ways:
-Payment by payment card
-Payment by bank order and operator verification
4.1. Payment by payment card electronic payment of ordered products is enabled through NLB Banka AD Skopje, with all MasterCard and VISA brand cards issued by any bank in the world, and electronic top-up is enabled with the same cards issued only in the Republic of North Macedonia. When paying by payment card, authorization is performed automatically online through the NLB Banka AD Skopje plugin (Bank Payment Gateway). After successful authorization, the User receives notification of the successful/unsuccessful payment via e-mail and/or SMS.
4.2. Payment by bank order and operator verification Payment by bank order can be made by a natural person or legal entity from all banks registered on the territory of the Republic of North Macedonia with an appropriate order for the transfer of funds after the online order has been placed and selecting the payment method “Payment by bank order”. After the payment has been made by the buyer, the operator employed to control and confirm the transaction is obliged to check the reliability of the data and the amount of the payment made with the bank order, after which the buyer is notified via SMS or e-mail, after which the delivery of the product(s) to the delivery address provided by the buyer is organized.
5. DELIVERY
After you have received confirmation of the created order, the order enters the processing status. Once processed and confirmed, it will be sent for delivery. The delivery of the order is carried out exclusively in the territory of the Republic of North Macedonia. The delivery period is 5 working days. All orders placed on Fridays or during the weekend will be processed on the first following working day. The working hours of our online shop are from 9 am to 5 pm during the week.
Shipments outside of Skopje are sent by courier service, most often through a courier service that has concluded a cooperation agreement with us.
If everything is in order with the shipment without any damage, feel free to take it and sign the delivery note that the courier will provide you. Each shipment has a delivery note in two copies. It is common practice that if the courier does not find you at the designated address, he will need to contact you on the phone number you indicated when creating the order and an agreement can be made for a new delivery date for the order. If in that case we still cannot find you at the indicated address, the order will be returned to us. Once we receive it, we will contact you to reach a conclusion and agree on re-sending.
Shipping Cost – The shipping cost for all orders with a value greater than 2990 denars is free!

6. LIABILITY OF Kokoda.mk IN CASE OF MISUSE, INAPPROPRIATE AND UNAUTHORIZED USE OF THE PAYMENT INSTRUMENT
Kokoda.mk completely disclaims any liability for damage that may be caused to the Buyer and/or third parties if it occurs as a result of inappropriate and unauthorized use of the payment card, i.e. if for any reason it is misused or used without the knowledge and consent of the owner or if it is stolen. In the above cases, Kokoda.mk is not obliged to refund the funds paid. Kokoda.mk is not responsible for the costs of the Buyer’s internet traffic and will not be liable for any damage that may occur as a result of an interruption of the internet connection at the time of using the electronic services when making an online purchase.
7. DATA PROTECTION AND SECURITY
Your privacy is important to us. We do not share your data with third parties except with those for which you have consented and we only store it for marketing, orders and platform analysis for which we have your consent. For more information, please read our privacy policy. Kokoda.mk is committed to protecting the privacy of data, including the personal data of the Buyer from the Kokoda.mk website and confirms that it will handle them in accordance with the Law on Personal Data Protection and other positive regulations in this area valid in the Republic of North Macedonia. The basic rules for collecting, using and protecting the data of all visitors to the Kokoda.mk website https://kokoda.mk/ are set out in the Privacy Policy, which is also published on the Kokoda.mk website, https://kokoda.mk/ .
In the terms of this Privacy Policy determine what data is collected during the visit or online registration and how it is used. When visiting the website, Kokoda.mk does not automatically collect personal data, except in cases where the Buyer voluntarily enters this information, for example, if the entry of personal data is mandatory for the purchase and sale of certain products and services, in the case of participation in surveys, additional marketing activities or requests for information by Kokoda.mk.
The principles set forth in the Privacy Policy apply to the protection of the data of all visitors to the Kokoda.mk website, including Buyers of products and services from the Kokoda.mk website. The Privacy Policy does not apply to visitors to other websites accessed through the Kokoda.mk website.
8. ELECTRONIC PAYMENT
Payment is made electronically, in real time upon the occurrence of the transaction. The security of the transactions made by the Buyer is guaranteed by NLB Bank AD Skopje. Electronic payment with payment cards is made with data that, for security reasons during communication over the Internet, is encrypted using a special SSL (Secure Socket Layer) protocol.
In addition, the data related to the Buyer’s payment card or his bank account are sent directly to the bank via an encrypted connection. Kokoda.mk does not collect the aforementioned data and does not have access to information related to the payment card or bank account. Kokoda.mk does not assume liability for damage due to unauthorized transactions or unauthorized use of the Buyer’s personal data during the realization of the electronic payment, since the entire electronic payment is within the jurisdiction of the Bank.
9. RETURN AND REFUND OF FUNDS
After delivery, there is no possibility to cancel the purchased product and to reverse the paid amount except in cases where the user has the right to cancel the purchase based on the mandatory provisions of the Consumer Protection Law.
If the Buyer decides to pay for the services/products with a payment card, there is a possibility of interruption of the internet connection at the time of payment. If the payment request is registered by Kokoda.mk, the Buyer receives an e-mail message or SMS with a report on the status of the payment made, i.e. a notification of whether the transaction was successful or unsuccessful. If the Buyer receives an e-mail or SMS confirmation of a successful payment, but does not receive the product within the specified period, in that case the Buyer may submit a complaint to any Kokoda.mk store or at https://kokoda.mk/contact .
The buyer is obliged to submit proof of confirmed payment and/or a bank statement for the completed transaction in addition to the complaint. Kokoda.mk will respond to all user complaints and claims within the legally stipulated period of 15 days.
10. DELIVERY COSTS
The costs of replacing products are borne by the buyer, except in cases where the buyer received a defective or wrong product.
11. RIGHT OF CANCELLATION/RETURN OF GOODS
The product can be returned within 15 days from the date of receipt of the shipment. The product must be undamaged and packaged in its original packaging with a label. Packaged products are returned to us via express mail to the address you receive from our sellers at your own expense.
In the event of a return of goods or a refund to a buyer who previously paid with any of the payment cards, in part or in full, and regardless of the reason for the return, Kokoda.mk is obliged to make the refund exclusively via VISA, EC/MC and Maestro, which means that the bank, at the seller’s request, will refund the funds to the cardholder’s account.
After the courier service delivers the shipment to you, please check the product and if there is visible damage (torn parts or crumpling) or the product does not comply with your order, please call us at 02/3223-640 or send us an email with your details (name, surname and phone) to the address https://kokoda.mk/contact and state the reasons why you want to exchange/return the package. Please contact us no later than within 24 hours of receiving the shipment.
Our operators will inform you about the further procedure, as soon as possible. You can replace the product in agreement with our operators. You send the product to be replaced to us via express mail, at your own expense. After receiving the product, we check whether the product is damaged, and then we send you an appropriate replacement. If the purchased product has defects in terms of the provisions of the Consumer Protection Law, please act in a manner defined by the regulation for consumer complaints for goods purchased through an online store, which together with You should send the completed complaint form to the address https://kokoda.mk/contact .
12. COMPLAINT
After the courier service delivers the shipment to you, please check the product and if there is visible damage (torn parts or crumpling) or the product does not comply with your order, please call us at 02/3223-640 or send us an email with your details (name, surname and phone) to the address https://kokoda.mk/contact and state the reasons why you want to exchange/return the package.

13. OTHER PROVISIONS
The product(s) are reserved for delivery upon receipt of payment confirmation by the Buyer. Simply placing the products in the cart does not mean that a reservation has been made and that the order is closed. If the order is not fully completed, i.e. the content of the order is still in the cart, and the time of inactivity of the Visitor/Buyer https://kokoda.mk/ is longer than 30 minutes, the content of the cart will be automatically deleted. Kokoda.mk reserves the right to amend these General Terms and Conditions as well as the content of https://kokoda.mk/ without prior notice, and the latest version of the General Terms and Conditions for online ordering, payment and purchase of services and/or products through the Kokoda.mk website, the user will be able to read on the Kokoda.mk website https://kokoda.mk/ . Kokoda.mk assumes no liability for any damage arising from the use of our website or the products you purchase through our website. We do not guarantee that our website will be uninterrupted, error-free or secure.
Amendments to these General Terms and Conditions shall enter into force on the date of their publication. I fully agree with the terms and conditions for e-commerce, online shopping and payment.
